Wednesday, October 11, 2017 Public Hearing and Regular Town Council Meeting at 7pm in Council Chambers

There will be a Public Hearing and Regular Town Council Meeting on Wednesday, October 10, 2017 at 7pm tin Council Chambers.  The following ordinance will be considered during the Public Hearing.

AN ORDINANCE AMENDING CHAPTER 10, ARTICLE A IN ITS ENTIRETY AND SETTING  FORTH THOSE  RESTRICTIONS  IN CONNECTION  WITH  FLOOD ZONES

                                                 PREAMBLE

This Ordinance was passed after full, open and public meeting and upon prior notice and opportunity for all interested parties to be heard and upon careful consideration, of the various conflicting interest

BE IT RESOLVED, Chapter 10, Article A, Section 10.10, Section 10.11, Section 10.12, Section 10.13, Section 10.14, Section 10.14.1 and Section 10.18, read as follows in the Town Code of Ordinances:

Any building or structure in Flood Zone A13 having a required elevation of 12 feet (A13 (11)) shall not exceed forty feet (40') in height measured from the highest, adjacent grade to the highest point of any permanent part of the structure. A permanent part of a structure shall include any addition to the structure secured by any means which did not otherwise appear in any document submitted to the Town for approval. Consistent with the foregoing, and in the following flood zones, the corresponding maximum heights of the highest, point of any permanent part of the structure shall be as follows:

 

(1)        Flood   Zone   A13   (12).....................................................41 feet

(2)        Flood   Zone   A13   (13).....................................................42 feet

(3)        Flood   Zone   V15   (14).....................................................43 feet

(4)        Flood   Zone   V15   (15).....................................................44 feet

(5)        Flood   Zone   V15  (16)......................................................45 feet

In no instance shall the maximum height of the highest point of any permanent part of the structure exceed 45 feet.

This Ordinance shall be applicable to all subsequent amendments to the Flood Insurance Rate Maps which may reflect different Zone designations and corresponding elevations from the present Maps.  As required by the Safety Code Regulations, fireplace chimneys shall not extend more than 3 ft. above the highest point of any permanent part of the structure as may be required by the building code.
